BOARD OF ADJUSTMENTS & APPEALS

The Ocean City Board of Adjustments and Appeals is created to hear and decide appeals of orders, decisions or determinations made by the Chief Building Official or designee relative to the application and interpretation of the adopted codes published by the International Code Council and the National Fire Protection Association contained within Chapter 10 of the Town Code, and to hear variances from Chapter 38 for flood variances, and Chapter 10, Article V for foundation variances. The Board shall adopt rules for the conduct of its business. The Board shall consist of five (5) members, and two (2) alternate members, none of whom are employees of the Town, and who shall be residents of Ocean City. The Board members shall be appointed by the Mayor and City Council, shall hold office at its pleasure and shall be qualified by experience and training to decide on matters pertaining to building construction, housing, property maintenance and floodplain management. The alternate members need not be appointed from any of the foregoing areas of expertise. The Chief Building Official shall be an ex officio member of the Board but shall not have a vote on any matter before the Board. For the conduct of any hearing, a quorum shall be not less than three (3) members of the Board, and in all instances, an affirmative majority vote shall be required to overrule any order, decision, or determination made by the Chief Building Official or designee or to grant a variance. When a quorum of the Board is not present to hear a matter, either the applicant or applicant’s representative shall have the right to request a postponement of the hearing.

Hearings are set upon request on the first and third Wednesday’s of the month at 3 PM in City Hall Executive Chambers.
