Stormwater Management and Critical Area measures are required for all development and redevelopment projects with a disturbed area greater than 250 square feet in order to minimize adverse impacts to water quality. If development is located within a Buffer Management Area, there is no disturbance minimum in place, and a full review will occur.

Atlantic Coastal Bays Critical Area (ACBCA)

All land within the municipal boundaries of Ocean City is considered within the Atlantic Coastal Bays Critical Area (ACBCA) program and is designated as an Intensely Developed Area (IDA).

During the site development review process, Staff will determine if mitigation plantings are required. Reasons for mitigation include, but are not limited to, increase in lot coverage, a change of use, tree/shrub removals, etc. A minimum 15 percent afforestation, the establishment of plantings on an open space and/or area absent of trees and shrubs, is required. Additional mitigation may be required if a site is located within the 100’ Buffer and/or a Buffer Management Area.

As part of the review process, all development/redevelopment, other than that of a Single-Family Dwelling, must comply with additional landscaping regulations, noted within Section 30-553 (8)(h) and 30-553(15) of the Town Code.

Stormwater Management

Development or redevelopment with a proposed Limits of Disturbance (LOD) of 5,000 square feet or greater must provide stormwater management measures that control or manage runoff. Stormwater management measures must be designed consistent with the design manual and constructed according to an approved plan for new development or the policies stated within the Town Code. Developers must demonstrate that Environmental Site Design (ESD) has been implemented to the Maximum Extent Practicable (MEP) before the use of a structural BMP is considered in developing the stormwater management plan. Review and approval of stormwater management plans occur in a three-step process, specifically, a Concept, Preliminary Site Development, and a Final site plan/stormwater management review.

Depending on the project, additional information will be required to be shown on the site plan or submitted with the site plan as follows:

          • Critical Area Project Application (Over 50% of site)
          • Critical Area Project Application (Under 50% of site)
          • Standard Single Family Stormwater Plan
          • Detailed topography and spot elevations
          • Stormwater Management Best Management Practices (BMPs) and calculations
          • Landscape Plan
          • Wetland delineations
          • Zoning density calculations
          • Required parking calculations
