OCEAN CITY TOWN ORDINANCES

Ocean City is proud to be home to one of America’s most popular and family-friendly boardwalks. Our 2.9-mile boardwalk stretches from the Inlet in South Ocean City to 27th Street. In addition to our famous boardwalk, our ten-mile stretch of beach and the beautiful Atlantic Ocean are free and open to the public from 5 AM to 12:00 Midnight. Ocean City also wants to ensure the safety of all beach visitors during beach maintenance. Sleeping on the beach is not allowed between 10 PM and 6 AM because we use the overnight and early morning hours to keep the beaches clean and beautiful. No private vehicles are permitted on the beach at any time.

For your protection, the Ocean City Beach Patrol is on duty during the summer between 10:00 AM and 5:30 PM every day from Memorial Day weekend through the third Sunday following Labor Day Monday. Please make sure to obey their instructions, swim near a lifeguard at all times, and have a buddy with you when you’re in the surf. The mission of the Beach Patrol is to provide safety for all beach-goers. Lifeguards on duty must have a clear line of vision and may establish said line running parallel to the ocean. Beach umbrellas, ball-playing, and other beach accessories will not be permitted eastward of said line.

Bonfires are allowed on the beach by permit only. More information, including regulations, restrictions, and the online permit application can be found at www.ocbonfires.com.

Bicycles, pushcarts, Class 1 Electric Bikes and EPAMDS are allowed on the boardwalk at the following times

From Saturday of Memorial Day weekend through Labor Day, between 2:00 a.m. – Noon.

From Tuesday after Labor Day through Friday before Memorial Day at any time.

Class 2 & 3 Electric bicycles are not allowed on the boardwalk at any time.

Boat Trailer Parking

If you are bringing a boat to Ocean City, please note that boat trailers can be parked at the 100th St. Municipal Lot for a fee. Boat trailers are not allowed on public streets, alleys, or public parking lots from May 1 to October 31.

Fireworks

In the Town of Ocean City, the discharge of all fireworks and pyrotechnics is prohibited, including ground-based sparklers sold or allowed in neighboring states and counties. Only small handheld sparklers are permitted and must be used under competent adult supervision. If you are interested in conducting organized fireworks displays, you must be a Maryland-licensed pyrotechnician and apply for a permit from the Fire Marshal’s Office.

Highway Safety

Millions of visitors travel to Ocean City each summer, making it crucial for vacationers to follow the highway laws to ensure safety and smooth traffic flow.

Bus/Bike Lanes:

  • Coastal Highway has bus/bike lanes on both sides. Do not park or drive in these lanes unless making a right turn. Be cautious of bicyclists when entering or leaving the highway.

Municipal Buses:

  • Municipal buses use the far right-hand lane on Coastal Highway, stopping only at designated bus stops. Be mindful of this when following a bus.

Pedestrian Right-of-Way:

  • Motorists must yield to pedestrians at crosswalks, at controlled intersections with traffic signals, and at non-signaled intersections.

Bicyclist Regulations:

  • Bicyclists must follow the same traffic laws as motorists and can receive citations for violations. Common violations include riding against traffic in the bike lane and ignoring traffic signals. Bicycles must have a headlight and rear reflector for night use in Ocean City.

Horseback Riding

Ocean City offers horseback riding on the beach during the winter and early spring. Individuals who wish to ride horses on the beach can apply for permits. Permit applications are available and required for this activity.

The cost is $20 for a single-day permit and $50 for a seasonal permit. Horseback riding will be allowed on the beach from November 1st to March 30th, between the hours of 6 a.m. and 5 p.m., starting at 27th Street and extending south to the Inlet jetty.

Noise Regulations

Remember that many visitors come to Ocean City to relax, so please be respectful of your neighbors both on and off the beach.

Noise Regulations:

  • It is unlawful to make, cause, or continue any loud, unnecessary, unnatural, or unusual noise that disturbs, annoys, injures, or endangers the comfort, repose, health, peace, and safety of others at any time, day or night.
  • Ocean City enforces a strict noise ordinance prohibiting disruptive noises between 12 midnight and 7 a.m. No noise should be heard at a distance of 50 feet from the building or structure where it originates.
  • According to Maryland Motor Vehicle Law and Ocean City Town Ordinance, no loud noise from a vehicle may be heard at a distance of 50 feet from the vehicle at any time.

Other Important City Ordinances to Note

Alcohol Consumption and Open Container Laws:

  • Drinking alcoholic beverages in public is prohibited. This includes any street, avenue, alleyway, sidewalk, beach, parking lot, and vehicle in these areas.
  • Possession of an open container of any alcoholic beverage in public is not allowed.

Sleeping Restrictions:

  • Sleeping in any motor vehicle within the city limits of Ocean City is prohibited.
  • Sleeping on the beach is not allowed between 10 p.m. and 6 a.m.

Parking Information

Ocean City has made efforts to ensure accessible parking for visitors.

Parking Availability:

  • Parking is available in city lots, private lots, and on certain public streets unless otherwise noted.
  • Ample free parking is available at the West Ocean City Park & Ride. You can park your car for the day and take the city bus into Ocean City.

Shuttle Service:

  • The West Ocean City Shuttle operates seasonally from May to October, running between the South Division Street Transit Center, West Ocean City Park & Ride, and the Tanger Outlet.

Parking Regulations:

  • Do not park in front of red painted curbs or in front of any public or private driveways.
  • When parking next to the curb, ensure your vehicle’s wheels are within 12 inches of the curb and parked with the flow of traffic.

Pedestrian Safety

It’s important for every Ocean City visitor and resident to prioritize safety and responsibility when walking around town.

Pedestrian Safety:

  • Cross streets only at marked crosswalks, especially those with pedestrian signal lights for added safety.
  • Maryland law mandates pedestrians to use sidewalks where provided, rather than walking in the street.
  • Avoid walking or jogging in the bus/bike lanes on Coastal Highway to prevent accidents and maintain traffic flow.

Prohibited Activities:

  • Hitchhiking is strictly prohibited in Ocean City for safety reasons.

Pet Parents

If you’re bringing your dog to Ocean City, it’s essential to be aware of the regulations regarding pets:

Beach and Boardwalk Access:

  • Dogs are permitted on the beach and boardwalk only between October 1 and April 30 each year.

Responsibilities of Dog Owners:

  • Owners must clean up after their dogs and remove any waste deposited on public or private property.
  • Dogs must be kept on a leash when being walked in and around Ocean City to ensure safety and respect for other visitors.

Dog Playground:

  • A Dog Playground is available year-round at 94th Street and bayside. This designated area allows dogs to play and enjoy themselves in Ocean City.

RV Parking

In Ocean City, there are specific regulations regarding parking for RVs and other oversized vehicles:

Parking Restrictions:

  • Between May 1 and October 31 each year, RVs and other oversized vehicles are prohibited from parking in any municipal lot, public street, or alley. This regulation is mandated by Town Ordinance.

Definition of Oversized Vehicles:

  • An oversized vehicle is defined as one that is 21 feet 2 inches or longer and 6 feet 8 inches wide, requiring more than one standard parking space.

Skateboarding

In Ocean City, skateboarding is subject to specific regulations:

Skateboarding Prohibition:

  • Skateboarding is prohibited on any public street, public way, ramp, public alley, public sidewalk, public lots, or any other public property within the corporate limits of Ocean City.
  • This prohibition is enforced between April 1 and October 1 of each year.

Exceptions:

  • Skateboarding is allowed at designated public skateboard facilities or during public sponsored or authorized skateboard events.

These rules are implemented to ensure safety and maintain order in public areas, particularly during the peak tourist season in Ocean City.

Off-Season: No Restrictions

Smoking/Vaping (Tobacco, Nicotine or Marijuana Smoke and Vapor)

In Ocean City, Maryland, there are specific regulations regarding smoking and vaping:

Public Smoking and Vaping Laws:

  • Smoking or vaping cannabis in public is illegal in the State of Maryland.

Designated Smoking Areas:

  • Ocean City provides designated smoking areas on the beach to maintain cleanliness and accommodate both smokers and non-smokers.
  • These areas feature waste receptacles and are specifically designated for smoking.

Rules for Smoking and Vaping:

  • Smoking or vaping must be contained within 15 feet of the waste receptacle within each designated smoking area on the beach.
  • The Ocean City boardwalk is designated as a smoke-free zone.

Applicable Substances:

  • These rules apply to cigarettes, cigars, pipes, vaping devices, e-cigarettes, and any other substances containing tobacco.

These regulations aim to promote a clean and enjoyable environment for all visitors to Ocean City while respecting public health and safety concerns.

Surf Fishing

It is illegal to surf fish or surf cast on public beaches from Memorial Day weekend Friday to September 30, between 10:00 a.m. and 5:30 p.m., unless you have permission from the Mayor and Council. This rule is in effect to maintain safety and enjoyment for swimmers and beachgoers. Surf fishing or surf casting is also prohibited within 50 yards of anyone swimming, walking, sitting, lying, surfing, or standing on the beach. * Also, note that you are required to have a Saltwater Fishing License. Swimming
